Understand, I wish you well, and hope things come to a resolution you are happy with.. But am doubtful you have much legal recourse against FR.

Among other things, you and your lawyer will have to prove the frame was/is faulty, and that you never overloaded/crashed/dragged/etc it.. They have a lot of evidence on their side, like the fact that it isn't any kind of regular thing.. in fact, it's just about the only one I remember after 10 years of joining the Pod world.. If you get lucky, catch them on a good day, maybe they will (for good will) repair it, but there is of course no requirement for them to do anything after the warranty period.

Well, two actually.. Yet the main one is the extended warranty I purchased. The other is NH Warranty Law, of which I am a resident, purchased and took delivery in NH.

Again, hoping for the simplest resolution to this.

FR has not offered an extended warranty for several years, did you buy an aftermarket warranty through your dealer? If so, that's not on FR at all, that's between you and the warranty provider.

My impression was that it was FR extending the policy. Now this is scary..

That would mean there would be a separate agreement within my paperwork showing the provider.. Or so you'd think.. I have to think through this information.

Still a hand I don't wish to show right now..

Yet another motto I live by (with certain modifactions)
Better to remain silent and be thought (having all info) than to speak (and showing you do not). Hopefully it will not come to that.

I'm awaiting the next update and will probably make a trip over there and request copies of everything. I'm thinking If done right, I still don't expose my hand and get what I need.. I do so dis-like going through all this..

I don't understand the need for a bunch of subterfuge, and in fact, if I was on the other side of this, it would reduce the chances of my doing anything in good faith, when an owner tried to spring something or trap me/my dealership.

I don't understand the NH law reference.. I doubt the state can make a company honor an expired warranty that was disclosed as being a 1 year warranty at purchase. (regardless of an extended warranty or other purchase)

Huh?? I have done anything underhanded here? All I am doing is educating myself of what 'could' be the eventual outcome. Don't know about you, but I'd rather have the knowledge and never have to use it, then need it and have no freakin' clue what to do.

To the second point, you can not devise a contract that does follow the Law. The Law supersedes. Heck, anything can be argued in court, but the decision is according to Law.
In my state, you can not sell an item 'as is'. Any sale carries, by Law, a implied warranty of what you sold/purchased, will do what it is designed to do. Factored by age of the item and a few other things..
In my state this has a 4yr maximum limitation. Again, depending upon item and age of.

But.. you didn't buy it, nor did they sell it as/is.. They told you, and you agreed to, a one year warranty from FR, and apparently purchased an extended warranty.. If your state says you somehow get a 4 year warranty, regardless of the contract.. why buy an extended warranty? Why would the dealership offer it? I also, think, near as I can tell, you intend to argue it wasn't "suitable" to use for the purposes you bought it for.. ie: camping. But it was, you camped in it. The fact that it got damaged, doesn't mean it wasn't suitable.

As far as underhanded, that's not what I said. But your reluctance to contact and work with the dealer or FR, so as not to "show your hand" at least to me, strongly implies you intend to try to spring something on them, or catch them in some way doing you wrong. At least that's how I see it.

Again, I wish you all the luck in the world, and am very interested in the outcome. I hope you keep us updated on the proceedings and the eventual outcome/repair.

BTW, did you find any information on the extended warranty you purchased?

[QUOTE=furpod] If your state says you somehow get a 4 year warranty, regardless of the contract.. why buy an extended warranty?

If I knew then, what I know now... I wouldn't have.

Why would the dealership offer it?

It's called Sales. Personally, I don't know if even the Dealership fully understands this Law.

I also, think, near as I can tell, you intend to argue it wasn't "suitable" to use for the purposes you bought it for.. ie: camping. But it was, you camped in it. The fact that it got damaged, doesn't mean it wasn't suitable.

What the argument presented, if it comes to such, will be determined at that point. Nothing, nor any approach has been determined.

As far as underhanded, that's not what I said.

Ah, but you did, by definition of the word ' subterfuge'.

But your reluctance to contact and work with the dealer

I am in contact with the Dealer and we have agreed to weekly updates and conversation.

or FR, so as not to "show your hand" at least to me, strongly implies you intend to try to spring something on them, or catch them in some way doing you wrong. At least that's how I see it.

Then your reading into this wrong and making suppositions based on your own belief of events.
How do I explain this better.. Are you a chess player? It's a game of strategy and knowledge of the moves. The more knowledge you have, the better the opportunity of succeeding. I'm not going to tell you my next move, (nor explain my capability) I'll await yours, and determine what I need to do.  Same applies here. I have said what I 'need' to say to them to let them know I have knowledge.

Again, I wish you all the luck in the world, and am very interested in the outcome. I hope you keep us updated on the proceedings and the eventual outcome/repair.

Thank you for that, but I'm not basing the outcome on luck. I do hope that all gained knowledge never has to come into play. I am hoping, all can be worked out to a reasonable repair.

I do like the approach my Dealership is taking. We have spoken about this. It's obvious it is not their first 'Rodeo'.

BTW, did you find any information on the extended warranty you purchased?

My intention there is as we proceed and I need to go in and review 'all' documentation and conversations I will ask for their copy for my review. Again, I hope not to reach this point.

I have no intention of 'springing' anything on them. And by Law, I can no do so. All intent has to be disclosed before any legal action can happen. Doing otherwise breaches 'any' warranty. Preparing for such an event is smart and legally within my rights to do.

I do have in mind a repair, of which I'd be willing to pay additional, to have done as I wish it to be. That I believe will be an eventual outcome of the situation. Without research and knowledge... where would I be?

I'll keep you folks posted as I am. Some information will obviously remain with me and the Dealership.
